Terms of service

These terms are a contract between you and WizCommerce LLC (“we,” “us”), the company that operates the Quilldove shop. They cover your use of this website and any purchase of goods from us. By using the site, asking to be notified about a product, or placing an order, you agree to these terms. If you do not agree, do not use the site or send us an order.

The shop

Quilldove sells home textiles: bedding, small washable rugs and runners, and coir and rubber doormats. We sell to addresses in the fifty United States and the District of Columbia. We do not ship to other countries or, at this time, to U.S. territories. Prices, shipping charges, and refunds are in U.S. dollars.

Who may use the site

You must be able to form a binding contract where you live. If you are using the site for a household, you confirm that you are at least 18, or the age of majority where you live if that age is higher. The shop is not directed to children.

Product information

We describe fibers, sizes, colors, and care as carefully as we can. Photographs show the color and character of a piece. Screens and dye lots differ, and a swatch on your screen is a guide, not a guarantee of an exact match. Dimensions are finished sizes and can vary slightly in cloth goods and natural fiber.

A product marked “Coming soon” is not available to purchase. A request to be notified, whether you leave an email on the page or write to us, is a request that we contact you when that size and color can be ordered. It is not an order, it does not reserve inventory, and it does not create a price guarantee.

Prices and taxes

Prices shown on the site are in USD and do not include sales tax, unless a page says otherwise. We may change a price before an order is accepted. The price on your invoice is the price you pay. Where we are required to collect sales tax, it is added from the ship-to address and stated on the invoice.

Orders

When purchasing is open, you submit an order by providing a U.S. shipping address and the goods you want. We accept the order when we send a confirmation or a payment invoice for those goods. We may decline or cancel an order if a piece is unavailable, if we suspect fraud or resale abuse, if the address is outside our shipping area, or if we made a pricing or description error. If we cancel after you have paid, we refund the amount paid for the cancelled goods and any related tax and outbound shipping.

An order is a sale of goods to you for personal or household use, unless we agree in writing to a different arrangement. You are responsible for the accuracy of the size, color, and address you submit.

Payment

Payment is in U.S. dollars. When card checkout is offered, Stripe processes the payment and collects a U.S. shipping address. We do not ask you to type a full card number into this website, and we do not store full card numbers. If card checkout is unavailable, you may request an invoice instead. An order ships after payment, unless the invoice says otherwise. Title to the goods passes to you when we receive payment and the carrier has accepted the package, subject to your return rights.

Shipping and returns

Delivery is covered by our shipping policy. Returns, exchanges, and defects are covered by our returns policy. Those policies are part of these terms. A 15% restocking fee applies to a return within 30 days. Unopened items that are defective, and returns caused by our error, are exempt from that fee. You pay return shipping unless the item is defective or the return is our error. If a sentence in a policy conflicts with this page on a question of liability or governing law, this page controls. Acceptable use

You agree not to:

• Use the site in a way that breaks the law or these terms.
• Attempt to probe, scrape, or disrupt the site, or to gain access to another person’s order.
• Post or send content that is unlawful, misleading, or that infringes someone else’s rights.
• Use our name, product copy, or photographs to impersonate the shop.

Intellectual property

The Quilldove name, the site design, and our product text belong to WizCommerce LLC or its licensors. You may not copy the catalog for your own store. Photographs are used under the licenses named on our image credits page. Those credits do not transfer any extra rights to you. You may share a link to a product page.

Disclaimer

The site and its content are provided on an “as is” basis. We work to keep the catalog accurate and the site available, and we do not warrant that the site will be uninterrupted or error-free. Goods are described on their product pages and covered by the returns policy if they are defective or not as described. To the extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow an implied-warranty disclaimer, and in those states it applies only as far as the law permits.

Limitation of liability

To the extent allowed by law, WizCommerce LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of your use of the site or a purchase, even if we have been advised of the possibility. Our total liability for a claim about a product is limited to the amount you paid us for that product. Our total liability for a claim that is only about the website, and not about a product you bought, is limited to one hundred U.S. dollars.

These limits do not apply to liability that cannot be limited under the law of your state, including liability for fraud, or for death or personal injury caused by gross negligence. Nothing in these terms takes away a non-waivable consumer right.

Indemnity

If you misuse the site, violate these terms, or infringe someone’s rights while using the site, you will indemnify WizCommerce LLC and its members and agents against the resulting claims, damages, and reasonable attorneys’ fees, to the extent the claim was caused by your conduct. This section does not require you to indemnify us for our own negligence or for a product defect.

Governing law and disputes

These terms are governed by the laws of the United States and of the state in which WizCommerce LLC is organized, without regard to conflict-of-law rules. You and we agree that the state and federal courts in that state are the venue for a dispute arising out of these terms or a purchase, except that either of us may bring an individual claim in small-claims court where that court has jurisdiction. Before filing, you agree to email us and give us 30 days to try to resolve the matter.

We do not require arbitration, and you do not waive the right to join a class action except where a court or your state’s law requires otherwise.

Changes

We may update these terms by posting a new version on this page with a new date. The version in effect when you place an order applies to that order. Continued use of the site after we post a change is acceptance of the new terms for use of the site going forward. If a change is material, we will note the date at the top of this page.

Other terms

If a court holds one part of these terms unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These terms, together with the shipping policy, the returns policy, and the privacy policy, are the entire agreement between you and us about the site and your purchases. They do not create rights for any other person. You may not assign your rights under these terms. We may assign ours in connection with a reorganization or sale of the business.
